By accessing or using Bland Maps ("Service"), operated by Bland Productions LLC ("Company," "we," "us," "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, you must not access or use the Service. Your continued use of the Service following the posting of any changes to these Terms constitutes acceptance of those changes.
You must be at least 13 years of age to use the Service. By using the Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into a binding agreement. If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.
Bland Maps is a web-based mapping and navigation service that provides interactive maps, driving/walking/cycling directions, route planning, points of interest, business listings, live aircraft tracking, and related geographic information services. The Service utilizes data from OpenStreetMap, OSRM routing, Nominatim geocoding, OpenSky Network, ArcGIS satellite imagery, and other third-party sources. The Service is available globally, but accuracy, detail, and completeness of map data, directions, and business listings vary significantly by region and locality.
THIS SECTION IS OF CRITICAL IMPORTANCE. PLEASE READ IT CAREFULLY.
Bland Maps provides navigation directions, route suggestions, and estimated travel times for informational purposes only. By using the navigation and directions features of the Service, you expressly acknowledge and agree to the following:
Business listings, points of interest, reviews, hours of operation, and other commercial information displayed on the Service are user-submitted, sourced from third-party data providers, or derived from publicly available data. Bland Productions LLC does not independently verify the accuracy, completeness, or currency of business listings. Businesses may have moved, changed hours, closed permanently, or otherwise changed since the information was last updated. You should independently verify business information before relying on it.
You retain ownership of any content you create, upload, post, or otherwise submit to the Service ("User Content"), including but not limited to business listings, reviews, map edits, photos, and comments. By posting User Content, you grant Bland Productions LLC a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, publicly display, and publicly perform such User Content in connection with operating and providing the Service. You represent and warrant that your User Content is accurate to the best of your knowledge, does not violate these Terms or applicable law, and does not infringe any third party’s rights. We reserve the right to remove any User Content at our sole discretion without notice.
You agree NOT to use the Service to: (a) violate any applicable law or regulation; (b) scrape, crawl, data mine, or use any automated system to access or collect data from the Service without our express written authorization; (c) interfere with, disrupt, or create an undue burden on the Service or the networks or services connected to the Service; (d) attempt to gain unauthorized access to the Service, other user accounts, or computer systems connected to the Service; (e) upload malware, viruses, or any other harmful code; (f) use the Service to engage in any activity that could damage, disable, or impair the proper working of the Service; (g) use the Service for any unlawful or fraudulent purpose; (h) impersonate any person or entity; (i) use the Service to generate route data or map data in bulk for commercial redistribution without authorization.
The Service and its entire contents, features, and functionality — including but not limited to all software, code, interface design, text, graphics, logos, icons, and the design, selection, and arrangement thereof — are owned by Bland Productions LLC, its licensors, or other providers of such material and are protected by United States and international copyright, trademark, and other intellectual property laws. Map data is sourced from OpenStreetMap and is available under the Open Database License (ODbL). Satellite imagery is provided by ArcGIS/Esri and is subject to their terms of use. No right, title, or interest in or to the Service is transferred to you, and all rights not expressly granted are reserved by Bland Productions LLC.
The Service relies on data and services from the following third-party providers, each of which has their own terms of service and privacy policies:
We have no control over and assume no responsibility for the availability, accuracy, or content provided by these third-party services. The Service may be impacted by downtime, data changes, or policy changes at any of these providers. Your use of the Service constitutes acceptance of the applicable terms of these third-party providers.
Bland Productions LLC is not responsible for any data charges, bandwidth charges, mobile carrier fees, or other costs incurred by you as a result of accessing or using the Service. Use of the Service, particularly map tile loading, satellite imagery, and navigation features, may consume significant amounts of mobile data. You are solely responsible for managing your data usage and any associated costs.
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. BLAND PRODUCTIONS LLC DOES NOT WARRANT THAT: (A) THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE; (B) THE RESULTS OBTAINED FROM USE OF THE SERVICE WILL BE ACCURATE, RELIABLE, OR CORRECT; (C) ANY DIRECTIONS, ROUTES, DISTANCES, OR TRAVEL TIME ESTIMATES WILL BE ACCURATE OR REFLECT CURRENT CONDITIONS; (D) MAP DATA WILL BE COMPLETE, CURRENT, OR FREE OF ERRORS; (E) BUSINESS LISTINGS WILL BE ACCURATE OR UP TO DATE; (F) THE SERVICE WILL BE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK. NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM BLAND PRODUCTIONS LLC OR THROUGH THE SERVICE SHALL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THESE TERMS.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BLAND PRODUCTIONS LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, SUCCESSORS, AND ASSIGNS SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, LOSS OF USE, LOSS OF GOODWILL, PERSONAL INJURY, PROPERTY DAMAGE, BODILY HARM, DEATH, OR OTHER INTANGIBLE LOSSES, RESULTING FROM: (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (B) ANY DIRECTIONS, ROUTES, OR NAVIGATION INFORMATION PROVIDED BY THE SERVICE; (C) ANY INACCURACY OR INCOMPLETENESS IN MAP DATA, BUSINESS LISTINGS, OR OTHER CONTENT; (D) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; (E) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT; OR (F) ANY OTHER MATTER RELATING TO THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE.
IN NO EVENT SHALL THE TOTAL AGGREGATE LIABILITY OF BLAND PRODUCTIONS LLC FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE EXCEED ZERO DOLLARS ($0.00). YOU ACKNOWLEDGE THAT THE SERVICE IS PROVIDED FREE OF CHARGE AND THAT THIS LIMITATION OF LIABILITY IS A FUNDAMENTAL ELEMENT OF THE AGREEMENT BETWEEN YOU AND BLAND PRODUCTIONS LLC.
You agree to defend, indemnify, and hold harmless Bland Productions LLC, its officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to: (a) your violation of these Terms; (b) your use of the Service, including but not limited to any navigation or directions you follow or attempt to follow; (c) any accident, injury, death, or property damage arising from or related to your use of the Service; (d) your User Content; (e) your violation of any rights of any third party; or (f) your violation of any applicable law or regulation while using or as a result of using the Service.
You expressly acknowledge and agree that your use of the Service is at your sole risk. You assume full responsibility for all risks associated with using the Service, including but not limited to risks arising from navigation and directions, walking or cycling on suggested routes, reliance on map data or business listings, and any other use of geographic information provided by the Service. You acknowledge that real-world conditions may differ materially from the information displayed by the Service.
Bland Productions LLC reserves the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice, for any reason or no reason. We shall not be liable to you or to any third party for any modification, suspension, or discontinuance of the Service. We do not guarantee that the Service will be available at all times or in all locations. Service availability may be affected by maintenance, updates, server outages, network issues, third-party service disruptions, or other factors.
Bland Productions LLC shall not be liable for any failure or delay in the performance of its obligations under these Terms due to causes beyond its reasonable control, including but not limited to: acts of God, natural disasters, pandemic, war, terrorism, riots, embargoes, fire, floods, earthquakes, power outages, internet service disruptions, cyber attacks, or government actions.
ANY DISPUTE, CONTROVERSY, OR CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL BE DETERMINED BY BINDING ARBITRATION ADMINISTERED BY THE AMERICAN ARBITRATION ASSOCIATION ("AAA") IN ACCORDANCE WITH ITS COMMERCIAL ARBITRATION RULES. THE ARBITRATION SHALL TAKE PLACE IN PEORIA COUNTY, ILLINOIS. THE ARBITRATOR’S DECISION SHALL BE FINAL AND BINDING. YOU AGREE THAT ANY ARBITRATION UNDER THESE TERMS WILL TAKE PLACE ON AN INDIVIDUAL BASIS; CLASS ARBITRATIONS AND CLASS ACTIONS ARE NOT PERMITTED, AND YOU ARE AGREEING TO GIVE UP THE ABILITY TO PARTICIPATE IN A CLASS ACTION.
You represent and warrant that you are not located in a country that is subject to a United States government embargo, or that has been designated by the United States government as a "terrorist supporting" country, and that you are not listed on any United States government list of prohibited or restricted parties.
If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to accomplish its objectives to the greatest extent possible under applicable law, and the remaining provisions shall continue in full force and effect.
These Terms, together with the Privacy Policy, constitute the entire agreement between you and Bland Productions LLC concerning your use of the Service and supersede all prior or contemporaneous communications, proposals, and agreements, whether electronic, oral, or written.
The failure of Bland Productions LLC to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
You may not assign or transfer these Terms without the prior written consent of Bland Productions LLC. Bland Productions LLC may freely assign or transfer its rights and obligations under these Terms without restriction.
These Terms shall be governed by and construed in accordance with the laws of the State of Illinois, United States of America, without regard to its conflict of law provisions. Any legal action or proceeding not subject to the arbitration provision above shall be brought exclusively in the state or federal courts located in Peoria County, Illinois, and you hereby irrevocably consent to the personal jurisdiction and venue of such courts.
We reserve the right to modify these Terms at any time. If a revision is material, we will provide at least thirty (30) days’ notice prior to any new terms taking effect by posting the updated Terms on the Service. By continuing to access or use the Service after revisions become effective, you agree to be bound by the revised Terms. If you do not agree to the new Terms, please stop using the Service.
